Introduction

Setting sail in the maritime industry comes with a sea of responsibilities, and one crucial aspect is ensuring compliance with regulations. Opening a Maritime Holding Account (MOHA) in the Union Registry is one such pivotal step in getting EU ETS compliant.

   

Let’s be prepared for a seamless compliance process.

Company Specifics

• A copy of the instruments establishing the shipping company, i.e. DOC and Certificate of Incorporation copy

• A document listing the ships under the shipping company’s responsibility and their respective IMO ship identification number

 

• A document providing the shipping company's bank account details

 

• A copy of the shipping company's annual report or the latest audited financial statements, or if no audited financial statements are available, stamped by the tax office or the financial director.

Legal Representative

• Evidence to support the identity of the shipping company's legal representative and all authorised representatives.

 

• Evidence to support the address of the shipping company's legal representative and all authorised representatives.

 

Note: Supporting documents for the above points include:

 

           o an identity card that contains the address of the permanent residence, 

 

           o a passport

   

• A copy of the criminal record of the shipping company's legal representative and all authorised representatives.

Mandate Agreement by Ship Owner (For ISM Mangers)

A document indicating that the shipping company or person (such as the manager) shall comply with the ETS obligations, where the shipping company or person has assumed the responsibility for the operation of the ship from the shipowner.

The mandate document includes: (What is applicable)

 

• the name, IMO number for Unique company, and registered owner identification number of the organisation or person mandated by the shipowner

 

• the country of registration of the organisation or person mandated by the shipowner, as recorded

 

• under the IMO number for Unique Company and Registered Owner Identification Number Scheme

 

• the name and the IMO number for the unique company and the registered owner identification number of the shipowner

 

Information required from the ship owner includes:

   

           o first name of the contact person

 

           o last name of the contact person

 

           o job title of the contact person

 

           o business address

 

           o business telephone number

 

           o business email address

 

           o the date of application of the mandate from the shipowner to the organisation or person

 

           o The IMO ship identification number of each ship falls within the scope 
           of the mandate

   

The document shall be signed by both the shipowner and the organisation or person (such as the manager). The document must be certified and legalised as a true copy by a notary public or other similar person. The date of the certification and legalisation shall not be more than three months before the date of application.

Other Requirements:

• The annual fee payment receipt for opening and maintaining a Maritime Holding Account (MOHA).

 

• A document identifying the group's structure, if the shipping company (ISM Manager or the ship owner) is part of a group.
